By accessing or using AEROMIND ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

AEROMIND is an adaptive aviation exam preparation platform designed to help pilots study for Transport Canada written examinations. The Platform provides:

• Adaptive quizzes using Computer Adaptive Testing (CAT)
• Spaced repetition flashcards
• Progress tracking and analytics
• Study materials aligned with Transport Canada standards

3. User Accounts

To use the Platform, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to:

• Share your account with others or allow unauthorized access
• Copy, distribute, or reproduce Platform content without permission
• Attempt to reverse engineer or extract the underlying algorithms
• Use the Platform for any unlawful purpose
• Interfere with or disrupt the Platform's operation
• Misrepresent your identity or affiliation

5. Intellectual Property

All content on the Platform, including but not limited to text, questions, explanations, graphics, logos, and software, is the property of AEROMIND or its licensors and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial educational purposes.

6. Educational Disclaimer

IMPORTANT: AEROMIND is a study aid and supplement to your aviation training. The Platform:

• Does NOT guarantee you will pass any Transport Canada examination
• Does NOT replace proper flight training from a certified instructor
• Does NOT constitute official Transport Canada study materials
• Should be used in conjunction with approved training resources

You acknowledge that passing aviation examinations requires comprehensive preparation beyond any single study tool.

7. Subscriptions and Payments

Certain features may require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Automatic renewal unless cancelled before the renewal date
• Our refund policy as stated at the time of purchase

8. Organization Accounts

If you access the Platform through a flight school or organization:

• Your organization may have access to your progress data
• Additional terms from your organization may apply
• Your access may be terminated if your affiliation ends

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AEROMIND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Failure to pass any examination
• Career or professional consequences
• Loss of data or service interruptions

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the province in which AEROMIND operates, without regard to conflict of law principles.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated terms on this page. Continued use of the Platform after changes constitutes acceptance of the new Terms.
